Kashmir Legal Strategy

Kashmir Legal Strategy: Pakistan is at an important diplomatic moment. Such opportunities are rare. Countries often wait many years for them. Pakistan now has a chance to strengthen its position on Kashmir.

Diplomatic Opportunity

For many years, Pakistan faced international criticism. Many countries ignored its views. Recently, Pakistan helped reduce tensions between the United States and Iran. This role improved Pakistan’s image. It also increased its diplomatic importance around the world.

The main question is how Pakistan should use this goodwill. Diplomatic support does not last forever. Pakistan should adopt a new strategy on Kashmir. It has not fully used international legal institutions to support its case.

Understanding Lawfare

This strategy is called lawfare. Lawfare means using international law to achieve political goals. Legal cases can influence global opinion. They can shape diplomatic discussions. They can also strengthen a country’s position. Smaller countries can use lawfare to increase their influence.

Global Examples

Several countries have used lawfare successfully. Mauritius challenged Britain’s control of the Chagos Archipelago through international law. It gained support from many countries. In 2019, the UN General Assembly (UNGA) asked the International Court of Justice (ICJ) for an advisory opinion. The opinion was not legally binding. However, it increased international pressure on Britain. The ICJ also issued an advisory opinion on the Occupied Palestinian Territory in 2004. That opinion still influences international discussions today.

Pakistan’s Response

Pakistan should follow a similar approach. For many years, India has shaped the global discussion on Kashmir. On August 5, 2019, India removed the special constitutional status of Indian-administered Jammu and Kashmir. Pakistan was not fully prepared for this step. Since then, it has not developed a strong and consistent legal strategy.

Legal Pathway

Pakistan should launch a well-planned lawfare campaign. It should bring international attention back to Kashmir. It should also highlight the Kashmiri people’s right to self-determination.

Article 96 of the UN Charter offers an important legal option. It allows the UN General Assembly to request an advisory opinion from the ICJ. This process does not require Security Council approval. No country can block it with a veto. Therefore, Pakistan can use this legal path.

Building Support

Pakistan should first seek a UNGA resolution. The resolution should request an ICJ advisory opinion. Pakistan only needs a simple majority of the countries that are present and voting. This task is mainly diplomatic. Pakistan must build support before presenting the resolution. The Organization of Islamic Cooperation (OIC) can help. However, support from Global South countries will be more important.

Key Questions

Pakistan should frame the legal questions carefully. It should not ask the ICJ to decide sovereignty over Jammu and Kashmir. Instead, it should focus on the Kashmiri people’s right to self-determination. It should also ask about the legal effects of denying this right. It should question changes to the demographic and constitutional status of the disputed territory.

Expected Impact

India will strongly oppose this effort. It says Kashmir is a bilateral issue. However, Pakistan can rely on existing UN Security Council resolutions. These resolutions recognize Kashmir as an unresolved dispute.

An ICJ advisory opinion will not solve the Kashmir dispute overnight. However, it can change the international debate. It can increase legal and diplomatic pressure on India. It can also encourage more countries to examine the issue closely.

Global Pressure

A favorable ICJ opinion could make it harder for India to avoid international discussion. Other governments may review their policies. They may also pay closer attention to India’s actions. The opinion would provide strong legal support for future negotiations.

For many years, India has limited international debate on Kashmir. An ICJ advisory opinion could reopen that debate. India would have to defend its position more often. This change would increase diplomatic pressure on New Delhi.

Next Challenge

Pakistan’s recent diplomatic role has improved its international standing. It has earned goodwill from many countries. It also has legal precedents that support its case. In addition, it can use a legal process that avoids the Security Council veto.

Pakistan’s first challenge is to win support in the UN General Assembly. It must convince a majority of member states. If it succeeds, the case can move to the International Court of Justice in The Hague.

Way Forward

This strategy may not succeed. However, important opportunities rarely come at the perfect time. Pakistan should combine legal planning with strong diplomacy. It should use its current diplomatic advantage to launch a long-term legal campaign on Kashmir. The cost of doing nothing may be greater than the risk of taking action.
